支援谁? 科索沃公投非法还是合法? 还是先科普下国际法吧!
关于 民族自决 的国际法如下
UN Charter (1945)
Article 1 第一章
To develop friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples
为了建立国际间的友好关系, 各国必须尊重各国平等的原则, 以及人民的民族自决.
International Covenant on Civil and Political Rights (1966)
Article 1
All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.
United Nations General Assembly Resolution 1514 (1960)
6. Any attempt at the partial or total disruption of the national unity and the territorial integrity of a country is contrary to the purposes and principles of UN Charter
基本上要想从一个国家独立至少是以下三种情况之一:
1双方都同意 例如 捷克斯洛伐克解体
2是殖民地 例如 摩纳哥
3现任政府没有遵守R2P 即 Responsibility to protect(保护的责任) 例如 楼主所说的科索沃
科索沃属于单方面独立, 既没有塞政府之同意,也非殖民地, 故其独立理由为现任政府没有遵守R2P.
所谓R2P为:
1, 一个政府有责任保护其公民免于 种族灭绝,战争罪行,人权罪行以及种族清洗 的伤害.
2. 国际社会有权利制裁该政府,如果他没有遵守第一条.
3. 如果政府无法保护公民免于以上4种暴行的伤害, 并且无法和平处理, 国际社会有权对该政府进行强制制裁包括经济制裁, 军事干预将被视为最后的手段. |
